While it was certainly interesting in the Roberts nomination hearings to see Arlen Specter immediately bring up Roe v. Wade –
and point out how the allegedly “conservative” (a world that should never be used, except in postmodern quotation marks) Rehnquist Court has consistently thrown out all manner of legislative decisions,
thus, as Specter rightly pointed out, engaging in precisely the “activism” the right constantly claims “liberals” are guilty of –
the rest of it was kind of sad … not pathetic, as some of these things can be … but just sad …
The Dems made clear they weren’t happy with the failure of Roberts to stray “off-message” – by actually saying something about any number of relevant judicial political issues –
but they couldn’t seem to figure out how to actually get him “off-message” and into some substance …
So I was wondering why some Democrat couldn’t say something like this to Roberts:
